Is the subcontractor Licensed, and I don't mean Occupational license?<br>

If the subcontractor is not properly licensed, they have no Lien Rights and
they have no right to sue for non payment.<br>

If the sub is licensed but missed the deadline for filing a lien, they can
still sue to get paid.<br>

Since the lien has not been filed in atimely manner, no one has lien rights
anyway.<br>

Yes the "Design Company" needs a contractors license, and if they
don't have the proper license, they committed a crime by working as an
unlicensed contractor.<br>

The unlicensed contractor or "Design Company" needs to make sure
the subs get paid and the unlicensed design company can be sued for triple
damages.<br>

I suggest the client contact the DBPR and local law enforcement about the
unlicensed design company.<br>

Explain to the lady that this is the kind of stuff that happens when you hire
unlicensed contractors and try to play games with permits.<br>

I hate to say it, but she deserves what she gets for hiring an unlicensed
contractor.<br>

IAEI Names David E. Clements to Serve as CEO and Executive Director<br>
<br>
Richardson, Texas-- The International Association of Electrical<br>
Inspectors (IAEI) today announced that its board of directors has named<br>
David E. Clements to serve as the company's chief executive officer and<br>
executive director.<br>
<br>
Clements has served since 1998 as chief electrical inspector of Nova<br>
Scotia Power Inc., where he is responsible for overseeing the Electrical<br>
Inspection Department. Clements began his electrical career in 1973 as<br>
an apprentice electrician, receiving his training and education through<br>
the Nova Scotia Institute of Technology, which led to the receipt of his<br>
certificate of qualification as a construction electrician in 1978. <br>
<br>
After several years in the electrical trade, working for a local<br>
electrical firm, he decided in 1981 to take a position with Nova Scotia<br>
Power as an electrical inspector. Five years later, he was promoted to<br>
an electrical inspection specialist. He is a certified engineering<br>
technician and has received a Certificate in Management from the<br>
Canadian Institute of Management through Saint Mary's University.<br>
<br>
Presently, Clements sits as a voting member on the Technical Committee<br>
on Canadian Electrical Code, Part I, and is a member of the Regulatory<br>
Authority Committee and the Canadian Advisory Committee on Electrical<br>
Safety.<br>
<br>
He was international president of IAEI in 2007 and served on the board<br>
for 13 years. During his tenure on the board he chaired a number of<br>
committees including fiscal affairs and long range planning.<br>
<br>
Clements said, "A major benefit of the IAEI is the strength of its<br>
membership and the many network and educational opportunities it<br>
provides its members.? It is critical to continue to add and retain<br>
members, and the organization must continue to offer the best possible<br>
member benefits in order to achieve this. We must ensure that our<br>
members have useful career tools that assist them in staying ahead of<br>
the latest electrical trends, accessible and diverse opportunities for<br>
networking and strong professional development. "<br>

Clements will take up his new duties on July 1, 2010, and join IAEI's<br>
board. He succeeds James W. Carpenter, a 37-year member of IAEI, who has<br>
been chief executive officer since 2002.<br>

I have a question that I know someone can answer for me. I did take the<br>
class on Florida Lien Laws but that was a couple of years ago and I cannot<br>
remember everything so before I begin to research this I am sure one of you<br>
Ladies or Gentleman may have a better memory than me. <br>

Here is the Scenario<br>

Just recently I have started doing many different jobs for a wonderful<br>
customer. Before I Started working for her? she hired a Design Company to<br>
remodel 2 of her bathrooms for a job total of $ 42,000.00. I've seen the<br>
work that they had done and the job came out really nice. Here is her<br>
problem. She told me today that she had paid the design company in full on<br>
May 15th when the job was completed. She received a phone call today from<br>
one of the sub contractors that said that they were not paid. First I looked<br>
at her invoice and did not see a license number. A red Flag went up. I asked<br>
her if she had paid each different Contractor separately. She did not.<br>
Apparently the design <br>

Company is acting as a contractor. Red flag came up again. I asked her if<br>
there was a permit pulled. Her answer was no I didn't want my taxes to go<br>
up. My next question was did you sign a notice of commencement. No she did<br>
not. I KNOW STUPID, STUPID, STUPID that is why she should hire a contractor.<br>
I then asked if she had received any registered letters from suppliers or<br>
Sub contractors introducing themselves before they had started any work .<br>
The 3 Ways I know are registered letter , A letter handed to her, or a<br>
letter posted at the job. She told me that yes she did receive 2 registered<br>
letters at first but they were only from 2 of the subs out of approximately<br>
5. My question is this. What exactly has this woman gotten herself into? I<br>
would hate to see her have to pay for this again. I would also hate to see<br>
the subs not get paid. Should she see a lawyer? Can a Designer act as a<br>
contractor? How can people educate themselves to hire a contractor?<br>

still file a Lien, even if a permit was required, but not pulled.<br>

Designer can not act as contractor on any job that requires a permit unless
they have a contractors license.<br>
<br>
If the subs that say they didn't get paid were electrical, plumbing or HVAC
they probably don't have much standing as they know that their work requires
a permit and there was none.<br>
<br>
Also if I remember correctly a sub only has 90 days after their last day on
the jobsite to send a "NOTICE TO OWNER" or they lose their
mechanics lien rights.? (it's been lots of years since I took the test so
maybe that's changed)<br>

Has she contacted the "design firm"?? Are they still around?<br>

? Just recently I have started doing many different jobs for a wonderful
customer. Before I Started working for her? she hired a Design Company to
remodel 2 of her bathrooms for a job total of $ 42,000.00. I've seen the work
that they had done and the job came out really nice. Here is her problem. She
told me today that she had paid the design company in full on May 15th when
the job was completed. She received a phone call today from one of the sub
contractors that said that they were not paid. First I looked at her invoice
and did not see a license number. A red Flag went up. I asked her if she had
paid each different Contractor separately. She did not. Apparently the design

? Company is acting as a contractor. Red flag came up again. I asked her if
there was a permit pulled. Her answer was no I didn't want my taxes to go up.
My next question was did you sign a notice of commencement. No she did not. I
KNOW STUPID, STUPID, STUPID that is why she should hire a contractor. I then
asked if she had received any registered letters from suppliers or Sub
contractors introducing themselves before they had started any work .. The 3
Ways I know are registered letter , A letter handed to her, or a letter
posted at the job. She told me that yes she did receive 2 registered letters
at first but they were only from 2 of the subs out of approximately 5. My
question is this. What exactly has this woman gotten herself into? I would
hate to see her have to pay for this again. I would also hate to see the subs
not get paid. Should she see a lawyer? Can a Designer act as a contractor?
How can people educate themselves to hire a contractor?<br>
