Well gosh, let me just think out loud here...

 

The definition of repair is rather misleading in that it appears to
speak to minor maintenance.

 

REPAIR. The patching, restoration and/or minor replacement of materials,
elements, components, equipment and/or fixtures for the purposes of
maintaining such materials, elements, components, equipment and/or
fixtures in good or sound condition.

 

However, the repair classification clearly includes cases of substantial
structural damage where it is the applicant's intent to restore the
building back to original conditions. I suppose the BO has the authority
to construe the definition to either extreme depending on the
circumstances. And of course I can appreciate the importance of having a
situation like this classified as a repair. 

 

I have to ask myself a few questions:

1. How does the applicant demonstrate the original configuration and
that the proposed construction is not an alteration? Does the BO require
the new partitions and openings to meet egress and accessibility
requirements? This seems like wholesale alteration.

2. New structural members must meet the current code and the entire
building as a whole must meet the wind provisions of the current code by
407.3.2.1.1. What is the course of action if the portion of the building
that is still standing requires alteration to meet current wind code?
